Resolving Obstacles in Granting Land Use Right Certificates at the Nam Dong Ma Urban Housing Project

On the afternoon of April 21, Mr. Vu Viet Van — Member of the Provincial Party Standing Committee and Vice Chairman of the Provincial People’s Committee — chaired a meeting to hear the Department of Construction’s report on solutions to resolve obstacles in granting Land Use Right Certificates and Ownership of Assets Attached to Land at the Nam Dong Ma Urban Housing Project (Thanh Mieu Ward). The meeting also reviewed the partial adjustment of the 1/2000 scale zonal planning (Sub-zone 5) within the Hoa Binh Lake National Tourism Area in Tan Mai Commune.

Resolving Obstacles in Granting Land Use Right Certificates at the Nam Dong Ma Urban Housing Project

The Nam Dong Ma Urban Housing Project, invested by BV Invest Joint Stock Company, has been implemented since 2005 and has undergone multiple planning adjustments and changes in legal entity status. The project comprises 259 lots: 66 are eligible for transfer, 140 have houses built but lack as-built documentation, and 53 remain vacant. The entire project is slated for completion and commissioning by the end of the fourth quarter of 2026.

To date, the investor has coordinated with authorities to split the General Certificates according to adjusted planning, initially completing the separation of 27 General Certificates into 186 individual ones. However, many cases remain unresolved due to coordinate discrepancies, land consolidation issues, or insufficient legal eligibility.

Notably, among the 140 built lots, most structures were constructed before 2012. Given the long duration, it is impossible to supplement as-built records according to current regulations. This hinders the issuance of certificates to residents, directly affecting their legal rights and posing a risk of prolonged complaints.

The Department of Construction proposed that the Provincial People’s Committee allow the processing of these issues based on the actual current state of the structures, ensuring alignment with planning, technical standards, and financial obligations, without requiring the re-creation of construction dossiers according to standard procedures.

Concluding this topic, Vice Chairman Vu Viet Van emphasized that resolving obstacles at the Nam Dong Ma project is an urgent task that must be handled definitively. He requested the Department of Construction to lead and coordinate with relevant sectors to classify each specific case, ensuring no omissions or negative practices.

Regarding the partial adjustment of the 1/2000 scale zonal planning (Sub-zone 5), the Department of Construction stated that the adjustment stems from practical needs after Tan Mai Commune was established through the merger of Son Thuy and Tan Thanh communes.

Currently, the administrative infrastructure is inadequate. Tan Mai Commune proposed adjusting a portion of rural residential land at the old Son Thuy communal headquarters to administrative land for a centralized working complex. Additionally, the plan adds resettlement areas to relocate residents from landslide-prone zones along the Da River. The adjustment also re-allocates land for education, healthcare, tourism services, and reserve land for socio-economic development.

Vice Chairman Vu Viet Van fundamentally agreed with the Department’s proposal, stressing that the adjustment must ensure long-term synchronization and align with the sustainable development of the Hoa Binh Lake area. He assigned the Department of Construction to collaborate with relevant units to organize the formulation, appraisal, and submission for approval in accordance with regulations to remove “bottlenecks” in land management.
